Returns & Refunds Policy

At Smoky Jays, we want you to be happy with your purchase. If you change your mind or something is wrong with your order, these terms explain how returns and refunds work. Nothing here affects your statutory rights under UK consumer law.

1. Cooling-off / change-of-mind returns

If you buy online as a consumer, you usually have 14 days from the day you receive the goods to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To be eligible for a change-of-mind return: the item must be unused and in its original condition; it should be returned in its original packaging where reasonably possible; all accessories, manuals and components supplied with the product should be included; and the product must not have been damaged, modified or used beyond what is reasonably necessary to inspect it. We may make a reasonable deduction from the refund where goods have been handled beyond what is needed to establish their nature, characteristics and functioning.

2. Faulty, damaged or incorrect items

If your item arrives damaged, faulty or is not what you ordered, contact us as soon as possible. Under the Consumer Rights Act 2015 you may be entitled to a repair, replacement or refund. We will work with you on the appropriate remedy. Nothing in this policy limits those rights.

3. Return postage

For change-of-mind returns, you are responsible for the cost of returning the item to Smoky Jays unless we agree otherwise. Where an item is faulty, damaged on arrival or incorrectly supplied, we will cover reasonable return costs where applicable.

4. Refunds

Once we receive and inspect the returned item, we will process your refund. Refunds are normally made to the original payment method. Where you cancel under the Consumer Contracts Regulations, we will refund in line with those rules, including delivery costs where the law requires (standard delivery only, unless you chose a more expensive option).

5. Exclusions

Some products may be excluded from change-of-mind cancellation where the law allows (for example goods made to your specification or clearly personalised). Any such exclusion will be stated clearly before you buy. Sealed goods that are not suitable for return for health or hygiene reasons may also be excluded once unsealed, where permitted by law.

6. How to request a return

Contact us at sales@smokyjays.co.uk before sending anything back so we can give you return instructions. Include your order number and details of the item and reason for return.

7. Your statutory rights

This policy does not affect your statutory rights under the Consumer Rights Act 2015, the Consumer Contracts Regulations or any other applicable UK consumer protection law.

Smoky Jays (“we”, “us”, “our”) respects your privacy and protects your personal data in line with UK GDPR and the Data Protection Act 2018. This policy explains how we collect, use and look after your information when you visit our website, contact us or buy from us.

  • Order and transaction data — products ordered, amounts paid, delivery details and related records. Card payments are handled by our payment providers; we do not store full card numbers.

3. How we use your data and legal bases

We use personal data to:

  • take and fulfil orders, arrange delivery and provide after-sales support (contract performance);

  • meet accounting, tax and other legal obligations (legal obligation);

We use cookies and similar technologies that are necessary for the site and checkout to work, and may use analytics or preference cookies to understand how the site is used. Where non-essential cookies require consent under PECR, we will ask for it. You can also control cookies through your browser settings. Blocking some cookies may affect site features.

5. Who we share data with

We share data only where needed with trusted service providers such as ecommerce and hosting platforms (including Shopify when the live store is connected), payment processors, delivery partners and email or IT providers. They may only use your data to provide services to us and must keep it secure. We do not sell your personal data. We may disclose information if required by law or to protect our legal rights.

6. International transfers

Some providers may process data outside the UK. Where that happens, we take steps required by UK data protection law, such as relying on UK adequacy regulations or approved contractual safeguards.

7. How long we keep data

We keep personal data only as long as needed for the purposes above. Order and accounting records are typically retained for up to six years (or longer if the law requires). Marketing preferences and contact enquiries are kept for a shorter period unless we still need them to manage an ongoing relationship or claim.

8. Your rights

Under UK GDPR you may have the right to access your data, have it corrected or erased, restrict or object to certain processing, request portability, and withdraw consent where processing is based on consent. These terms apply when you buy from Smoky Jays online or otherwise place an order with us. By ordering, you agree to them. Nothing in these terms affects your statutory rights as a consumer under UK law.

2. Orders and contract formation

When you submit an order you are offering to buy the goods. We may accept, decline or cancel an order (for example due to stock, an obvious pricing error or suspected fraud). A contract is formed when we confirm acceptance or dispatch. You must provide accurate contact and delivery details.

3. Pricing and payment

Prices are in pounds sterling (GBP) and include VAT where applicable unless we say otherwise. We may correct obvious pricing mistakes before accepting an order. Payment is taken at checkout through our supported payment methods. Title in goods passes when we receive payment in full; risk passes on delivery to you (or to someone you authorise to receive the delivery).

4. Delivery

Free UK delivery over £50. Recorded, signed-for within 2 business days. Delivery timescales are estimates and may vary for large, specialist or made-to-order items, which we will explain where relevant. If we cannot deliver as arranged, we will contact you. If you are not available and goods are returned to us, we may charge a reasonable redelivery fee unless the failed delivery was our fault.

5. Cancellation and returns

If you buy online as a consumer, you usually have a 14-day cooling-off right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, subject to legal exceptions. 6. Product information and suitability

We aim to describe products accurately. Images are illustrative. You are responsible for checking that a product suits your needs, space and local rules before purchase. Always follow the manufacturer’s instructions for assembly, fuel, ventilation and safe use.

7. Warranty

Many products carry a manufacturer warranty in addition to your statutory rights. Warranty cover varies by brand and model. See Warranty & Safety on this page, and the documents supplied with your product, for details.

8. Liability

Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited under English law. Subject to that, we are not liable for loss of profit, business interruption or other indirect or consequential loss, and our total liability for any claim relating to a product is limited to the price you paid for that product.

9. Website use

You must not misuse the site, attempt unauthorised access, or use it for unlawful purposes. Site content belongs to Smoky Jays or its licensors and may not be copied for commercial use without our permission.

10. Governing law

These terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, without affecting any mandatory consumer protections that apply where you live in the UK.

Product Warranty & Safety

This section explains manufacturer warranties and important safety information for BBQ and outdoor cooking equipment sold by Smoky Jays. It does not replace the instructions supplied with your product, and it does not affect your statutory rights under the Consumer Rights Act 2015.

1. Your legal rights

Goods must be as described, of satisfactory quality and fit for purpose. If they are not, you may be entitled to a repair, replacement or refund within the time limits set by UK consumer law. Manufacturer warranties are additional benefits and do not replace those rights.

2. Manufacturer warranties

Many BBQs, cookers and accessories (including brands such as Kamado Joe and Pit Barrel Cooker Co.) include a manufacturer warranty. Cover, duration and what is excluded vary by product. Typical exclusions include fair wear and tear, misuse, incorrect assembly, use of unsuitable fuel, commercial use where the warranty is for domestic use only, and damage from weather exposure where the product was not protected as recommended.

Keep your proof of purchase. To make a warranty claim, contact us at sales@smokyjays.co.uk with your order number, product details and a description of the issue (photos help). We will advise whether to claim via Smoky Jays or the manufacturer and help you through the process.

3. What to do if something goes wrong

Stop using the product if you think it is unsafe or faulty. Do not attempt unauthorised repairs that could void a warranty or create a hazard. Contact us promptly so we can arrange inspection, repair, replacement or another remedy as appropriate.

4. General outdoor cooking safety

  • Use BBQs, smokers and outdoor cookers outdoors only, in a well-ventilated area, away from buildings, fences, dry vegetation and flammable materials.
  • Never use charcoal, wood or solid-fuel appliances indoors, in tents, garages or enclosed spaces — carbon monoxide can kill.
  • Place equipment on a stable, non-flammable surface. Keep children and pets at a safe distance.
  • Never leave cooking unattended. Allow the appliance to cool fully before moving or storing it.
  • Use only fuels and accessories recommended by the manufacturer. Dispose of ash safely when completely cold.
  • Follow all assembly, lighting, temperature and cleaning instructions supplied with the product.

5. Gas BBQ and gas appliance safety

Where you buy or use gas-powered equipment, follow the manufacturer’s gas-safety guidance in full. In particular:

  • Check hoses, regulators and connections for wear or leaks before each use. If you smell gas, turn off the supply if safe to do so, extinguish naked flames, ventilate the area and do not use the appliance until it has been checked.
  • Use the correct regulator and hose for your gas type (for example LPG). Do not modify gas parts unless a competent person does so in line with the manufacturer’s instructions and applicable UK gas safety rules.
  • Store cylinders upright, outdoors or as directed, away from heat sources, and never attempt to refill disposable cartridges incorrectly.
  • For fixed or complex gas installations, use a Gas Safe registered engineer where required.

6. Food hygiene

Cook food to safe temperatures, avoid cross-contamination, and clean grills and utensils properly after use. Follow any food-safety guidance supplied with thermometers or related accessories.
